TERMS AND CONDITIONS

These terms and conditions (the "Terms and Conditions") govern the use of www.cheflinkexpress.com.au (the "Site"). This Site is owned and operated by Chef Link. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

 

Intellectual Property

All content published and made available on our Site is the property of Chef Link or Chef Link partner/supplier and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

Accounts

When you create an account on cheflinkexpress.com.au, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

Sale of Goods

These Terms and Conditions govern the sale of goods available on our Site.

The following goods are available (and not limited to) on our Site:

  • Hospitality Supplies;

  • Commercial Kitchen Equipment;

  • Crockery & Glassware;

  • Cooking Equipment;

  • Cleaning Products; and

  • Uniforms.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Third Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

 

Embroidery & Special Orders

Your logo can be embroidered on any garment. We prefer that you email your artwork in a JPEG format, along with your Pantone/PMS/Madeira colours (if applicable), to sales@cheflink.com.au. Your logo will remain on file for any future orders.

There is a one-time digitising setup fee: $55.00 (cost subject to change). (Additional charges may be incurred if you make changes or adjustments to the logo that require re-digitising. Please call for more details.)

If required, we can send you a sample sew out at no cost to you. This is provided for your approval prior to embroidering your garment.

Each standard size logo is $9.90 incl GST (Logo prices vary depending on stitch count.)

The cost for one line of embroidery is $7.70 incl GST.

Give your coat an international flair with the addition of embroidered flags.

The price for each embroidered flag is $11.00.

Please allow 10-14 business days, plus appropriate shipping time, for delivery on all embroidered and special orders.

Embroidered items/special orders are non-returnable.

These measurements do not refer to the actual measurements of the garments. The garment will be larger than the body measurements in order to provide for comfortable movement.

To get the best fit, stand straight and relax.

Chest: Measurement is taken from the fullest part of the chest/bust with your arms down.

Waist: Measure around your natural waistline above the hips.

Hips: Measure around the fullest part of the hips.

Inseam: Measure from the base of the crotch to the bottom end of your pants. Or select a pair of pants that fits you well and measure along the inside leg seam from the crotch to the bottom of the hem.

Payments

We accept the following payment methods on our Site:

  • Credit Card;

  • PayPal; and

  • Direct Deposit.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Accounts, phone orders and in store orders may be paid via direct deposit.  Goods will not be shipped until the amount paid is cleared into the bank on COD accounts.

Shipping and Delivery

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Free Cairns City Delivery on orders over $80 - excluding large items;

  • Australia Post & Third Party Couriers - Delivery times will vary when using third party delivery services; or

  • Flat Rate Delivery to Atherton Tablelands, Port Douglas and Mission Beach.

  • Some items may be shipped directly from our suppliers.

  • Other shipping options are available on request.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays. Any in stock items will ship within 2-3 business days.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information. Please supply a physical address, not just a PO Box, on items not being delivered by Australia Post.

 

International Orders

Chef Link does not ship to destinations outside Australian mainland, Tasmania and Torres Strait Islands. If you require items to be shipped overseas your own courier/shipping must be pre-arranged.

 

Back Orders

Chef Link carries large inventories in stock, however, occasionally, a shortage will occur. It is our policy to fill backorders as soon as the merchandise is available, unless otherwise specified. Some backorders may ship directly from our suppliers to speed up order processing and minimise freight.

 

Returns and Refunds

Goods delivered may be returned for a refund, exchange or replacement within 30 days provided they are returned unused, in a saleable condition and in their original packaging. Certain large or bulky items may be subject to a restocking fee. Certain goods cannot be returned for hygiene purposes. Certain goods such as knives must be returned in adequate postal packaging for health and safety reasons. Certain last-in-line or special-to-order goods may also be non-returnable. 

Until further notice, products purchased from Chef Link within the following categories will not be eligible for return or refund due to change of mind:

  • Cleaning chemicals

  • Disposable food packaging including takeaway cups and cutlery

  • Paper towel products, paper napkins and toilet paper

  • Cleaning cloths and sponges

  • Disposable gloves

Refunds do not apply to the following goods:

  • Custom made, Custom ordered, embroidered items, items that have been used and items that have been damaged in transit by your own delivery service.

  • Any packaging item that has been opened. As packaging items are food grade and for food service, any that have been opened can not be returned in case of contamination.

Returns can be made by mail. To return goods by mail, follow the following procedure:

Undamaged and unused items must be returned in the same undamaged packing in which they were received. Customers will pay the cost of any return shipping. A restocking fee may apply.

 

Warranty

Goods sold by Chef Link are subject to the warranty and conditions of the individual goods manufacturer. Chef Link will hold copies of equipment serial numbers and invoices upto 2 years should you need to apply for a warranty repair or replacement. Chef Link will endeavour to help you claim a warranty but is not responsible should the manufacturer decline the warranty request.  All warranties only apply to items on the Australian mainland and Tasmania.  Goods held overseas or on islands will need to return the goods to base or pay for any repair technicians to visit the location, and will be responsible for the cost of returning the warrantied item to the Mainland.

All items will be inspected to ensure they are in good working order and have no damage prior to departing Chef Link. Any damage that occurs in transit prior to the item leaving the Chef Link warehouse, is not the responsibility of Chef Link and should be taken up with the transport carrier you selected

 

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

Product Display

While we have made every effort to display the colours of our products as accurately as possible, the actual colours you see will depend on your monitor, and we cannot guarantee that your monitor's display of any colour will be accurate.

 

Limitation of Liability

Chef Link and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

 

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Chef Link and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

 

Applicable Law

These Terms and Conditions are governed by the laws of the State of Queensland.

 

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

 

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

A small administrative fee may be payable for the provision of information.
